Never Hire an Illegal Domestic Worker
One in every two households in Thailand uses domestic workers in the form of nannies, maids, cooks, and carers.
Thai nationals are familiar with the process of recruitment, which means they are aware of and able to navigate most of the challenges inherent to the process.
However, the recruiting procedure could be more transparent for an expat. And one of the most challenging problems to solve is how to prevent hiring people who are not legally allowed to work in the country.
Illegal workers
Domestic workers such as Maids, Nannies, Caregivers, and Tutors, in Thailand are only legally allowed to be foreign nationals holding passports from Myanmar, Laos, or Cambodia. No other nationalities are accepted. This arrangement was made official by signing an international Memorandum of Understanding in 2009 between these three countries and Thailand.
Because of this, it is unethical for citizens of Vietnam, Malaysia, Indonesia, or the Philippines to look for domestic work in Thailand.
Despite this rule, hundreds of people still break the law by traveling to Thailand in hopes of finding employment in the country's domestic service industry. They will need current work permits or visas, neither of which they are qualified to get.
Remember that these illegitimate workers are una
ble to get legal work visas. Thus, they try to get around the law by misusing or abusing their vacation visas instead of working legally. Illegal employees must leave Thailand and enter neighboring countries once every 30 days to get a visa stamp from immigration to continue living in Thailand.
Before trying to 'transition' the visa to domestic employment, some would try to get false work visas for professions such as teaching assistants or private tutors. Because visas cannot be transferred from one employer to another, this conduct constitutes illegal immigration activity. As was said before, it is against the law for anybody who does not originate from Myanmar, Laos, or Cambodia to work lawfully as a domestic worker in Thailand.
Companies Without Moral Compass
You could have thought it was easy to understand, but this is untrue.
Although it is immoral for you to hire them and it is unlawful for an agency to represent them (online or in person), many nanny agencies in Thailand continue to employ and suggest these employees to their customers even though it is prohibited for the agency to do either of those things.
Several employment agencies are brazenly advertising jobs for undocumented employees on their websites. They are all interested in rapidly putting anybody, even illegal employees, with families that are naïve to the risks should they be found.
The Responsibility of the Customer
Employing someone not authorized to work in Thailand is considered a crime that may result in legal repercussions and should be avoided at all costs. You are the one who has to check that their documents are in order and comprehend the Thai Employment Law.
Although the first punishment is often a warning, if you (as an employer) continue to employ an unlawful domestic worker, you risk revoking your work permit and visa and paying a fine of up to 800,000 baht. This is because you have violated the Thai Employment Law.
